1. Agreement to Terms

By accessing and using the Pawlished Pets website and purchasing our products, you agree to be bound by these Terms and Conditions of Sale. These terms comply with New Zealand consumer protection laws, including the Consumer Guarantees Act 1993, Fair Trading Act 1986, and Sale of Goods Act 1908.

You must be 18 years or older to make a purchase on our website.

2. Definitions

  • "We," "us," "our" refers to Pawlished Pets
  • "You," "your" refers to the customer or website user
  • "Products" refers to pet grooming products sold through our website
  • "Website" refers to the Pawlished Pets online store

3. Product Information

We make every effort to display accurate product information, including descriptions, images, prices, and availability. However:

  • Colors may vary slightly due to screen settings
  • Product formulations may change; current ingredient lists are on product packaging
  • We reserve the right to correct errors in product information
  • Product availability is subject to change

4. Pricing

4.1 All Prices

  • Are in New Zealand Dollars (NZD)
  • Include GST where applicable
  • Exclude shipping costs unless stated otherwise
  • Are subject to change without notice

4.2 Price Errors

If a product is listed at an incorrect price due to a genuine error, we reserve the right to cancel the order before dispatch and notify you. You will have the option to purchase at the correct price or receive a full refund. This does not affect your rights under the Consumer Guarantees Act if you have already received the product.

5. Orders and Acceptance

5.1 Order Process

  • Your order is an offer to purchase products
  • Order confirmation email does not constitute acceptance — it is simply confirmation that we received your order
  • Acceptance occurs when we dispatch the products to you
  • We reserve the right to refuse or cancel any order before dispatch
  • If we cancel your order before dispatch, you will receive a full refund

5.2 Order Cancellation

We may cancel orders if:

  • Products are unavailable
  • Pricing errors occur
  • Payment cannot be authorized
  • We suspect fraudulent activity
  • Delivery address is outside our service area

6. Payment

6.1 Payment Methods

We accept payment via:

  • Credit/debit card (processed securely through Stripe)
  • Afterpay (subject to Afterpay's approval and terms)
  • Bank Transfer / Direct Deposit to our New Zealand bank account

Payment is required at the time of order for card and Afterpay purchases. For bank transfer orders, payment must be received within 48 hours of placing your order.

6.2 Payment Security

All card payment information is processed securely through Stripe. We do not store your payment card details.

6.3 Afterpay

Afterpay purchases are subject to Afterpay's terms and conditions. You must be approved by Afterpay to use this payment method.

6.4 Bank Transfer

For bank transfer payments:

  • Full payment must be received within 48 hours of placing your order
  • Orders will be dispatched once payment clears in our account
  • If payment is not received within 48 hours, your order may be cancelled
  • You must use the provided order reference number when making the transfer

7. Shipping and Delivery

7.1 Shipping Options

We offer shipping throughout New Zealand and to Australia via:

  • NZ Courier - Standard (1-2 business days): $12.50
  • Click & Collect (1 business day): Free

7.2 Delivery Timeframes

Estimated delivery times are business days from dispatch and are not guaranteed. Delays may occur due to factors beyond our control.

7.3 Shipping Address

You are responsible for providing accurate shipping information. We are not liable for delays or non-delivery due to incorrect addresses you have provided, provided we have dispatched to the address you specified.

7.4 Risk and Title

Risk of loss or damage to products passes to you upon delivery to the address you provided. Title (ownership) passes to you when we receive full payment and dispatch the products. If products are damaged in transit, your rights under the Consumer Guarantees Act are not affected.

8. Consumer Guarantees

Under the Consumer Guarantees Act 1993, all products must:

  • Be of acceptable quality
  • Match their description
  • Be fit for any purpose we say they are for
  • Be safe and durable

If products fail to meet these guarantees, you are entitled to a remedy. The remedy available depends on whether the failure is major or minor:

  • Major failure: You can choose a refund or replacement
  • Minor failure: We will repair or replace the product within a reasonable time

See our Refund & Returns Policy for full details. Nothing in these Terms and Conditions limits or excludes your rights under the Consumer Guarantees Act 1993, Fair Trading Act 1986, or other New Zealand consumer protection laws.

9. Product Use and Safety

9.1 Intended Use

Products are intended for pet grooming use only. We recommend that you:

  • Read product labels and instructions before use
  • Perform a patch test before first use (especially for pets with sensitive skin)
  • Keep products out of reach of children and pets when not in use
  • Discontinue use if adverse reactions occur and consult a veterinarian if necessary

9.2 Allergies and Sensitivities

If your pet has known allergies or sensitivities, we recommend checking ingredient lists carefully before use. Ingredient information is provided on product packaging and in product descriptions.

These recommendations do not limit your rights under the Consumer Guarantees Act if a product is not of acceptable quality or fit for purpose.

10. Limitation of Liability

To the maximum extent permitted by law, and except where the Consumer Guarantees Act 1993 or other consumer protection laws apply:

  • We are not liable for indirect, incidental, special, or consequential damages
  • We are not liable for damages arising from misuse of products or failure to follow product instructions
  • We are not liable for loss of profits, revenue, data, or business opportunities

Important: Nothing in these terms limits or excludes our liability for:

  • Failure to comply with the Consumer Guarantees Act 1993
  • Breach of the Fair Trading Act 1986
  • Death or personal injury caused by our negligence
  • Fraud or fraudulent misrepresentation
  • Any other liability that cannot be limited or excluded by New Zealand law

11. Intellectual Property

All website content, including text, images, logos, and product descriptions, is our intellectual property or used with permission. You may not:

  • Reproduce, distribute, or modify our content without permission
  • Use our trademarks or branding without authorization
  • Copy product images or descriptions for commercial use

12. Privacy

Your use of our website is subject to our Privacy Policy, which complies with the Privacy Act 2020 (NZ). Please review our Privacy Policy to understand how we collect and use your information.

You agree not to:

  • Use the website for unlawful purposes
  • Interfere with website functionality

14.2 Disputes Tribunal

For unresolved disputes under $30,000 NZD (or the current Disputes Tribunal limit), you may file a claim with the Disputes Tribunal of New Zealand. This is a low-cost, informal way to resolve consumer disputes.

14.3 Other Legal Remedies

Nothing in these terms prevents you from exercising any other legal rights or remedies available to you under New Zealand law, including approaching the Commerce Commission regarding Fair Trading Act matters.

15. Governing Law

These terms are governed by the laws of New Zealand. Any disputes will be subject to the exclusive jurisdiction of New Zealand courts.

16. Force Majeure

We are not liable for delays or failures in performance resulting from events beyond our reasonable control, including but not limited to:

  • Natural disasters, severe weather, or pandemics
  • Acts of government, war, or civil unrest
  • Strikes, labor disputes, or supplier failures
  • Disruptions to telecommunications, internet, or courier services

In such cases, we will make reasonable efforts to notify affected customers and fulfill orders as soon as reasonably possible. Your rights under the Consumer Guarantees Act are not affected.

17. Changes to Terms

We reserve the right to modify these terms at any time. Changes will be posted on this page with an updated date. Continued use of the website after changes constitutes acceptance of the updated terms.

18. Severability

If any provision of these terms is found to be invalid, unlawful, or unenforceable, that provision will be deemed severed and the remaining provisions will continue in full force and effect.
